Welcome to Sex Daisy (“we”, “us”, “our”). These Terms and Conditions govern your use of our website [www.sexdaisy.co.za] and the purchase of products through our online store. By accessing or using the site, you agree to be bound by these terms.
1. General
1.1 These Terms apply to all visitors, users, and customers accessing or using our website or purchasing products from us.
1.2 By using this site, you confirm that you are at least 18 years of age. We do not sell to or knowingly collect personal information from individuals under 18.
1.3 We reserve the right to update or modify these Terms at any time. Continued use of the website after changes have been posted constitutes your acceptance of the new terms.
2. Products and Availability
2.1 All products listed on our website are subject to availability. We reserve the right to limit quantities, discontinue products, or make changes to product specifications and pricing without prior notice.
2.2 While we make every effort to display products as accurately as possible, actual colours, shapes, or packaging may vary slightly from the images shown due to differences in screen displays or product updates.
3. Pricing and Payment
3.1 All prices are listed in South African Rand (ZAR) and include VAT, where applicable.
3.2 We accept secure online payments via Stitch Express and Paystack. All transactions are subject to verification and approval.
3.3 Full payment must be received before any order is processed or dispatched. We are not responsible for delays due to incomplete or failed payments.
4. Delivery
4.1 We use The Courier Guy and other reputable courier services for nationwide deliveries. Delivery times are estimated and may vary based on location and courier capacity.
4.2 All orders are shipped in discreet packaging, with no indication of the contents or the name of our store. Your privacy is of utmost importance to us.
4.3 Once your parcel is collected by the courier, risk passes to you. We are not responsible for delays, theft, damage, or loss during delivery. Please note that The Courier Guy does not offer insurance on parcels, and we cannot accept liability for courier-related issues.
4.4 We provide tracking details upon dispatch. You are responsible for ensuring someone is available to receive the parcel at the delivery address failing which, any cost related to delays or re-delivery will be at your expense.
5. Returns and Refunds
5.1 Defective or Damaged Items
If you receive an item that is defective, damaged, or not as described, you must notify us within 48 hours of delivery by contacting info@sexdaisy.co.za. Claims made after this period may not be honored.
To be eligible for a replacement or refund:
The issue must be clearly described and, where possible, supported with photos;
The item must be unused and in its original packaging;
You must provide proof of purchase (order number or receipt).
If approved, we will offer either a replacement, store credit, or a refund, depending on stock availability and the nature of the issue.
5.2 Non-Returnable Products
Due to the intimate and hygienic nature of our products, we do not accept returns or exchanges on the following items, unless they are defective or incorrect on delivery:
Sex toys, massagers, and devices intended for intimate use;
Lubricants, creams, massage oils, or any liquid or consumable product;
Lingerie, underwear, and intimate apparel;
Any product that has been opened, worn, or used;
Any product returned without its original, sealed packaging.
This policy is in line with South African health regulations and the Consumer Protection Act.
5.3 Cooling-Off Period Exemptions
In accordance with Section 42 of the Electronic Communications and Transactions Act (ECTA), the standard 7-day cooling-off period does not apply to goods which:
By their nature, cannot be returned for hygiene reasons;
Have been unsealed, used, or are intended for intimate bodily use.
We therefore cannot accept cancellations or returns simply due to a change of mind once an order has been dispatched, unless the item qualifies under clauses 5.1 and 5.2.
5.4 Return Shipping Responsibility
If a return is approved due to a defect or error on our part, we will cover the return shipping cost or arrange for collection. If the return is not due to an error on our part, you will be responsible for all return shipping costs. We recommend using a trackable service, as we are not liable for items lost in transit.
6. Cancellations
6.1 Orders may be cancelled prior to dispatch by contacting us directly at info@sexdaisy.co.za. Once dispatched, cancellations are no longer possible due to the hygiene-sensitive nature of our products.
6.2 We reserve the right to cancel any order at our discretion, including where products are unavailable or payment has not been completed. In such cases, a full refund will be issued.
7. Warranty
7.1 Not all products are sold with a manufacturer’s warranty. Where applicable, warranty terms will be stated on the product page or accompanying documentation.
7.2 We are not liable for product damage caused by:
Improper use;
Lack of cleaning or incorrect storage;
Use contrary to manufacturer instructions.
7.3 Any product faults or defects must be reported within 48 hours of delivery. Outside this timeframe, we may not be able to assist.
8. Limitation of Liability
8.1 To the fullest extent permitted by South African law, we are not liable for any indirect, incidental, or consequential damages arising from the use of our website or products.
8.2 Our liability is strictly limited to the purchase price of the product in question.
9. Privacy and Discretion (POPIA Compliance)
9.1 We respect your privacy and are fully compliant with the Protection of Personal Information Act (POPIA).
9.2 We collect and store only the personal information necessary to process and deliver your order. This information is kept confidential and is never sold or disclosed to third parties, except where required to fulfill your order (e.g., couriers or payment processors).
9.3 All parcels are packaged discreetly. Our name will not appear on the external label or packaging.

10. Marketing Communications Consent
By creating an account on our website, and/or checking out as a guest without an account, you acknowledge and expressly consent to the collection and use of your contact details (including your email address and/or mobile number) for the purpose of sending you marketing communications. These communications may include email marketing, SMS messages, and/or telephonic marketing related to our products, promotions, and services.
You understand that this processing of your personal information is done in accordance with the Protection of Personal Information Act, 2013 (“POPIA”), and that:
You may at any time opt out of receiving marketing communications by using the unsubscribe option provided in our emails, replying “STOP” to SMS messages where applicable, or contacting us directly.

11.1 These Terms are governed by the laws of the Republic of South Africa. Any disputes arising out of or relating to these Terms shall be resolved in the appropriate South African court of law.
